一般租赁条约1 - APPLICABLE REGULATIONSThis agreement (terms and conditions) is governed by the laws of England and Wales. Each party irrevocably and unconditionally submits to the non-exclusive jurisdiction of the courts of England and Wales. The Hotel Proprietors Act 1956 applies to this agreement. Residents should refer to the notices posted in the premises regarding the limitation on liability.The resident may not invoke the statutory provisions applicable to residential leases, particularly as to security of tenure.The use of the apartment as a principal place of business is also prohibited. If a resident makes a reservation for a period of more than 3 months or intends to occupy the apartment as his/her principal residence, the hiring will (if Citadines so requires) be subject to the resident signing an assured shorthold tenancy agreement in such form as Citadines shall require. 2 - COMPLETION OF AN AGREEMENT (THE CONTRACT)A booking shall only be confirmed following acceptance by Citadines of a client's reservation, and receipt of the resident's deposit (in accordance with clause 3). Citadines may elect at its own discretion to confirm reservations in writing.Group reservations require a written acceptance and confirmation. 3 - DEPOSITSReservations shall be binding only if guaranteed in full by a valid major credit card(*) or where prior credit arrangements have been agreed with Citadines, or where a deposit has been received for such reservation. The deposit for a reservation will be the equivalent of:
Reservations accepted by Citadines, subject to a deposit, will be held until five days before the scheduled arrival date. If the required deposit has not been received at least five days prior to the scheduled arrival date, the reservation will automatically be cancelled. For bookings with a lead-time of less than five days, payment of the deposit guaranteed by a major credit card(*) will be required. Group bookings are subject to the group contract terms.A group booking is any booking of 8 rooms and more, emanating from a single entity. 4 - SETTLEMENT OF INVOICESInvoices are to be settled upon presentation without delay. Citadines will invoice for the entire duration of the stay on the date of arrival, except for stays extending beyond a 15 days duration,in which event invoices will be presented in 15 days increments. In cases where payment for a resident's stay has been arranged to be settled by someone other than the resident (“a Paying Entity”), the resident will be required to provide a guarantee by major credit card (*) and the resident will be responsible personally for payment if the Paying Entity does not pay. Payments for additional services will be required on presentation of the invoice without delay. The credit limit for such additional services is Euros 200/£130. 5 - PRICE QUOTATIONThe price for hiring a unit depends upon the duration of the stay. Our current prices (which Citadines is able to adjust at its sole discretion) are available on application to the company and on our website. Prices are quoted in local currency for the apartment rental only (inclusive of VAT except for UK).The price of the rental includes the cost of water, electricity, gas, weekly cleaning and linen/towel services. The price of the rental does not include the costs of additional services requested and does not include any personal insurance cover. Citadines recommends that the resident should take out all relevant insurance cover. An inventory of equipment and utensils is placed in each apartment, and it is the obligation of the resident to verify the completeness of the inventory and the state of repair and condition of all equipment and utensils upon arrival in the apartment. In the event of discrepancies, the resident shall report such discrepancies within four hours of arrival to reception. If no discrepancy is reported, the resident is deemed to have accepted the inventory. 6 - MODIFICATION TO A RESERVATION, OR TO THE DURATION OF STAYSubject to availability and at the discretion of the management, the length of stay can be extended,although there will be no obligation to allocate the same apartment or to apply the same rate. If the duration of the reserved stay is to be shortened,then the applicable tarif for that shorter duration will come into force. Please note that a change of rate for a shortened or lengthened stay will be applied retrospectively to the resident's account.The new rate will be effective from the original date of arrival. 7 - CANCELLATION/NO SHOW POLICYA cancellation notified to Citadines at any time prior to mid-day (12:00) on the expected day of arrival, will not be subject to a cancellation fee. For a cancellation notified to Citadines at any time after mid-day (12:00) on the expected day of arrival or for a “no show”, Citadines will retain or invoice an amount as follows:
8 - OBLIGATIONS OF THE RESIDENTCitadines reserves the right to demand a security deposit on arrival. The apartment will be made available to the resident in good order. The resident is responsible for taking all reasonable care of the apartment and its contents. Except in the case of normal wear and tear, the resident will be responsible for making good any damage to the apartment or its contents which has occurred due to negligence, wilful damage or irresponsible behaviour on the part of those occupying the apartment or their guests. Such damage must be reported, without delay, to our local representatives. The cost of the repair or replacement must be agreed and paid to Citadines. A final inventory and check of the apartment will be conducted on or before the resident's departure. Citadines will charge a resident for any item of equipment or utensils missing from the inventory and/or for any damage caused to the apartment. We reserve the right to enter (either ourselves or through sub-contractors) the rented apartment at any time (with due regard to the convenience of the resident) for inspections, maintenance, cleaning and security purposes and to ensure due performance of this agreement by the resident. 9 - LIABILITYNeither Citadines nor its representatives:
Subject to this agreement,the resident (and/or the Paying Entity) indemnifies and holds harmless Citadines and its affiliates, subsidiaries, officers, employees a n d agents from and against any loss (including legal costs and expenses)or liability incurred at law, in equity or otherwise by any of those indemnified arising from any personal injury or death caused by any negligent act or omission by the resident. All information supplied by Citadines and our representatives is given in good faith and is based on information available at the time. All reasonable measures h a v e been taken to ensure the accuracy of any statement made, but neither Citadines nor our representatives shall be liable for any variation howsoever caused. 10 - TERMINATIONThe agreement will be terminated immediately and without notice in the event of the resident's non-performance of his or her obligations, or unsuitable conduct causing disturbance to other residents in the apartment residence.The resident shall leave immediately on request. 11 - GENERALThe resident acknowledges and consents to Citadines selling and/or transferring data and information passed in the execution of this agreement and related transactions. It is the intention of the parties that no term of this agreement may be enforced by any person who is not a party to this agreement (“Third Party”) notwithstanding that any such term may purport to confer, or may be construed as conferring, any benefit on such Third Party and irrespective of whether such Th i r d Party is identified in this agreement. The Contracts (Rights of Third Parties) Act 1999 shall not apply to any provisions of this agreement.
